Terms of Service

Welcome to THE GETOGETHER. These Terms of Service (“Terms”) are a legal agreement between you and THE GETOGETHER LLC (“THE GETOGETHER,” “TGT,” “we,” “us,” or “our”), a Georgia limited liability company, governing your use of the website togetogether.com, our membership services, and our in-person and online events (together, the “Service”).

Please read these Terms carefully. By creating an account or using the Service, you agree to them. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into this agreement to use the Service. By using the Service, you represent that you meet these requirements, that the information you provide is accurate, and that you will keep it accurate.

2. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at TGT@togetogether.com if you suspect unauthorized use. You may not share your account, create more than one account, or create an account if we have previously removed you from the Service.

3. Memberships, Payments, and Renewals

The Service offers membership tiers (currently Spark, Flame, and Inferno) and may offer paid events and other features. Key terms:

Billing. Paid memberships are billed through our third-party payment processor, Stripe. By subscribing, you authorize us and Stripe to charge your payment method for the applicable fees and any taxes.

Automatic renewal. Paid memberships automatically renew for successive periods (for example, monthly) at the then-current price until you cancel. You authorize recurring charges until you cancel.

Cancellation. You may cancel at any time through your account settings. Cancellation stops future renewals; you keep access to paid features through the end of your current billing period.

Price changes. We may change prices or features. We will provide notice of material changes, and changes apply to the next renewal after notice.

Refunds. Except where required by law, membership fees and event purchases are non-refundable. Specific event refund or transfer terms, if any, will be stated at the time of purchase.

4. Events, RSVPs, and In-Person Participation

A central part of TGT is curated in-person events (such as galas, meet-and-greets, dining experiences, outings, and partner events). The following apply to all events:

RSVPs and capacity. Some events have limited capacity. An RSVP or ticket does not guarantee entry if capacity is reached, if an event changes, or if these Terms or event rules are violated.

Changes and cancellations. We may reschedule, modify, or cancel an event. If we cancel a paid event, we will address ticket handling as described at purchase or as required by law.

Your conduct at events. You agree to behave lawfully and respectfully, follow venue and staff instructions, and comply with all applicable rules. We may remove you from an event, without refund, for unsafe, unlawful, or disruptive behavior.

Assumption of risk. Attending in-person events and meeting other members involves inherent risks. You choose to attend and interact with others at your own risk. TGT does not conduct background checks on members (see Section 7) and is not responsible for the conduct of members or third parties, on or off the Service.

Third-party venues and partners. Events may take place at third-party venues or involve partners. Those third parties may have their own rules and terms, and TGT is not responsible for their acts or omissions.

5. Community Rules and Acceptable Use

To keep TGT safe and welcoming, you agree that you will not:

Misrepresent your identity, age, or affiliations;

Harass, threaten, defame, stalk, or harm any person, on or off the Service;

Post content that is unlawful, obscene, hateful, discriminatory, fraudulent, or that infringes others’ rights;

Solicit money, gifts, or personal financial information from other members, or use the Service for commercial solicitation not authorized by us;

Use bots, scrapers, or automated means to access or collect data from the Service;

Attempt to disrupt, hack, or compromise the security of the Service; or

Use the Service for any unlawful purpose.

We may remove content and suspend or terminate accounts that violate these Terms.

6. Your Content

You retain ownership of the content you post. By posting content on the Service, you grant TGT a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content as needed to operate, promote, and improve the Service. You are responsible for your content and represent that you have the rights to post it and that it does not violate these Terms or the law.

7. No Background Checks

TGT does not conduct criminal background checks or verify the identity of members. We make no representations about the conduct, identity, or intentions of any member. You are solely responsible for your interactions with other members. Always use good judgment and take sensible safety precautions, especially when communicating privately or meeting in person.

8. Third-Party Services and Partners

The Service integrates or links to third-party services (such as Stripe for payments) and may feature merchant and event partners. Your dealings with third parties are governed by their terms, and TGT is not responsible for third-party products, services, or conduct.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, TGT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT YOU WILL FIND A MATCH OR HAVE A PARTICULAR EXPERIENCE AT ANY EVENT.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TGT AND ITS OWNERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, YOUR INTERACTIONS WITH OTHER MEMBERS, OR YOUR ATTENDANCE AT ANY EVENT. TO THE FULLEST EXTENT PERMITTED BY LAW, TGT’S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TGT IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless TGT and its owners, employees, and partners from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, your conduct toward other members, your attendance at events, or your violation of these Terms or the law.

12. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if we discontinue the Service. Sections that by their nature should survive termination (including content license, disclaimers, limitation of liability, indemnification, and governing law) will survive.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction, except where applicable law provides otherwise.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide notice. Your continued use of the Service after changes take effect means you accept the updated Terms.
